1. Who we are

2. Two kinds of data
- Your data as a customer: details of the people who create and use XORPENDA accounts. We decide how this data is used.
- Your visitors' data: data collected on the landing pages you publish with XORPENDA (for example form submissions, page views, clicks used for A/B tests and heatmaps). For this data you decide how it is used, and we process it only on your behalf as your service provider.
3. What we collect about customers
- Account details: name, business name, email, login details.
- Billing details: plan, invoices, billing address. Card payments are handled by our payment providers; we never see or store full card numbers.
- The briefs, content and settings you create in the app.
- Usage data: how you use the app, device and browser information, IP address and essential cookies.
- Support messages you send us.
4. How we use it
- To provide the service, take payments and manage your account.
- To keep XORPENDA secure, prevent fraud and abuse, and improve the product.
- To keep accounting and tax records.
- To send you product news, only if you opt in. You can unsubscribe at any time.
5. How we process your visitors' data
- We process it only on your instructions, to host your pages, run A/B tests, measure conversions and show heatmaps.
- We do not sell it, use it to market to your visitors ourselves, or combine it with other customers' data.
- Pixels and tags you connect send data to the platforms you choose; you are responsible for any notices or consent your visitors' laws require.
- We will tell you without undue delay if we become aware of a security incident affecting it.
6. AI processing
Your briefs and page content are processed by AI providers to generate copy, layouts and variants. They are used to provide the service to you and not to train AI models shared with other customers.
7. Who we share data with
We use carefully chosen service providers for hosting, payments, AI processing, analytics and customer support, under written contracts that protect the data. We share data with authorities only where the law requires it. We do not sell or share personal information for cross-context behavioral advertising.
8. International transfers
XORPENDA operates remote-first, with part of its operations team based in Spain, and some providers may process data outside the United States. When data is transferred, we use appropriate contractual safeguards.
9. How long we keep data
- Account data and content: while your account is open, and up to 30 days after closure.
- Billing records: as long as required for tax and accounting purposes (generally up to 7 years).
- Visitors' data: while the page or test exists, or until you delete it, and no longer than 30 days after your account closes.
- Support messages: up to 2 years.
10. Security
We use encryption in transit, access controls, logging and regular backups. No system is completely secure, so please keep your login safe and tell us straight away if you suspect unauthorized access. If a breach affects your personal information, we will notify you as required by applicable law, including the New Mexico Data Breach Notification Act.
11. Your privacy rights
Depending on where you live (for example California and other US states with privacy laws, or the EU/UK), you may have the right to know, access, correct, delete or receive a copy of your personal information, to opt out of certain processing, and not to be discriminated against for using these rights. If you visited a page built with XORPENDA, please contact the business that published it first, as it controls your data.
12. Cookies
Our website and app use essential cookies to keep you signed in and secure. We use analytics or marketing cookies only where permitted and, where required, with your consent.
13. Children
XORPENDA is not directed to children under 13 (or under 16 where applicable) and we do not knowingly collect their data.
14. Changes
If we change this policy in a way that matters, we will tell you by email or in the app before the change takes effect.
